Terms & Conditions
1. Changes to Terms & Continued Use
We reserve the right to update, amend, or replace these Terms & Conditions at any time. Material changes will be communicated via email or through a prominent notice on the platform. Continued access or use of the platform after any such changes constitutes your unconditional acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the platform and cancel your subscription before the next renewal date.
2. Account Security & Credential Responsibility
You are responsible for maintaining the confidentiality and security of your login credentials, including your email address and password. You agree to notify us immediately of any suspected unauthorized access to or use of your account. We may record session identifiers, device fingerprints, and login patterns to protect account integrity and detect unauthorized sharing or suspicious activity. You must not permit any other person to access your account using your credentials, and you are fully responsible for all activity that occurs under your account.
3. Communication Consent & Session Alerting
By creating an account and using the platform, you expressly consent to receive service-related, transactional, and security communications from us, including billing notices, subscription reminders, password-reset emails, and session security alerts. You agree that we may monitor and record session activity, device identifiers, and login events for the purpose of preventing fraud, enforcing account limits, and protecting platform security. This monitoring is conducted in accordance with our Privacy Policy.
4. Recurring Annual Charges & Billing Authorization
Subscribers authorize I Ching & Flying Stars to charge the registered payment method annually for the selected subscription tier. All online transactions are securely handled through our third-party payment processor, Stripe. By completing checkout, you confirm that you are the authorized cardholder or account holder and that all billing information provided is accurate. Failure to maintain a valid payment method may result in immediate suspension of tiered access without prior notice.
5. Strict No-Refund Policy
All subscription fees are non-refundable. Upon successful payment, subscribers receive instant digital access to proprietary calculation engines, analytics tools, and protected content. Because these are intangible digital deliverables that cannot be returned, no refunds, partial credits, or chargebacks will be granted. Initiating a payment dispute with your financial institution constitutes a breach of these terms and may result in permanent account termination.
6. Cancellation Policy
Subscribers may contact support to cancel their annual subscription at any time. Cancellation stops the next annual renewal; the current paid subscription period will remain active until its expiration date. No prorated refunds are issued for unused portions of the subscription term. Upon expiration, tiered features will be downgraded to visitor-level access.
7. Intellectual Property & Copyrights
All software, algorithms, visual compass overlays, chart layouts, brand marks, logos, ribbons, documentation, and generated output designs are the exclusive property of I Ching & Flying Stars and are protected by international copyright, trademark, and trade-secret laws. Subscribers receive a limited license to use the platform for personal or professional client work; they do not acquire any ownership, reproduction, or distribution rights in the underlying intellectual property. Reverse engineering, scraping, copying, or creating derivative works from our code or visual assets is strictly prohibited.
8. Licensed Text Graphic Output Policy
Subscribers are granted a non-exclusive, non-transferable license to capture screenshots, export digital reports, and share calculations generated by the Master Compass Canvas overlay for private client delivery or educational case studies. However, this clearance is strictly contingent upon all corporate logos, brand markers, and the 'I CHING & FLYING STARS' copyright ribbon remaining completely intact, unaltered, and visible within the output. Any attempt to crop, mask, delete, or white-label our visual brand assets to obscure platform ownership constitutes a direct violation of our Intellectual Property rights and will result in immediate permanent account termination without refund.
9. Non-Representation & Independent Contractor Status
Use of the platform does not create an employment, agency, partnership, franchise, or joint-venture relationship with I Ching & Flying Stars. Consultants and practitioners who use our tools to serve their own clients remain independent contractors solely responsible for their advice, client relationships, billing, and compliance with local regulations. We do not endorse, supervise, or control any practitioner’s professional services.
10. Disclaimer & Limitation of Liability
The platform provides analytical and educational tools based on classical Feng Shui frameworks. Results are not guaranteed and should not replace independent professional judgment or legal advice. I Ching & Flying Stars disclaims all liability for decisions, investments, renovations, or life choices made in reliance on platform output.
11. Total Exclusion of Liability for Third-Party Usage & Interpretation
Subscribers who share platform output, screenshots, reports, or interpretations with third parties do so entirely at their own risk. I Ching & Flying Stars accepts no responsibility for how third parties understand, apply, redistribute, or act upon any content derived from the platform. Any claim, dispute, or loss arising from third-party usage must be resolved between the subscriber and the third party; we shall not be joined as a party nor held financially liable.
12. Fraudulent Account Sharing & Eviction Clause
Each subscription is personal to the registered account holder and may not be shared, resold, sublicensed, or pooled across multiple users, agencies, or devices beyond the single active session permitted by our authentication system. We monitor login patterns, device fingerprints, and session anomalies to detect unauthorized sharing. Confirmed fraud or account sharing will result in immediate account suspension or permanent eviction, forfeiture of remaining subscription time, and no refund. Evicted users may be barred from re-registering at our sole discretion.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, government actions, strikes, pandemics, Internet service provider failures, or failures of third-party infrastructure providers.
14. Governing Law & Exclusive Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute, controversy, or claim arising out of or relating to these terms, including their existence, validity, interpretation, performance, breach, or termination, shall be resolved exclusively by the courts of Singapore. Each party hereby submits to the exclusive jurisdiction of the courts of Singapore and waives any objection to venue in those courts.
15. Severability & Entire Agreement
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms & Conditions, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and I Ching & Flying Stars regarding your use of the platform and supersede all prior agreements, understandings, and representations.
