Terms of Service

1. Changes to Terms & Continued Use

We reserve the right to update, amend, or replace these Terms of Service at any time. Material changes will be communicated via email or through a prominent notice on the platform. Continued access or use of the platform after any such changes constitutes your unconditional acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the platform and cancel your subscription before the next renewal date.

2. Account Security & Credential Responsibility

You are responsible for maintaining the confidentiality and security of your login credentials, including your email address and password. You agree to notify us immediately of any suspected unauthorized access to or use of your account. We may record session identifiers, device fingerprints, and login patterns to protect account integrity and detect unauthorized sharing or suspicious activity. You must not permit any other person to access your account using your credentials, and you are fully responsible for all activity that occurs under your account.

3. Communication Consent & Session Alerting

By creating an account and using the platform, you expressly consent to receive service-related, transactional, and security communications from us, including billing notices, subscription reminders, password-reset emails, and session security alerts. You agree that we may monitor and record session activity, device identifiers, and login events for the purpose of preventing fraud, enforcing account limits, and protecting platform security. This monitoring is conducted in accordance with our Privacy Policy.

4. Recurring Annual Charges & Billing Authorization

Subscribers authorize I Ching & Flying Stars to charge the registered payment method annually for the selected subscription tier. All online transactions are securely handled through our third-party payment processor, Stripe. By completing checkout, you confirm that you are the authorized cardholder or account holder and that all billing information provided is accurate. Failure to maintain a valid payment method may result in immediate suspension of tiered access without prior notice.

5. Digital Delivery & No-Refund Policy

All subscription purchases are strictly non-refundable once digital delivery begins, except where applicable statutory consumer law explicitly mandates otherwise. Upon payment confirmation, subscribers receive immediate access to proprietary calculation engines, analytical toolkits, and protected practitioner materials. By completing purchase, you expressly request immediate digital fulfillment and acknowledge that any statutory right of withdrawal or cooling-off period is waived to the fullest extent permitted by applicable law.

Except in cases of verified technical duplicate billing caused by a system error, no refunds, partial refunds, or prorated credits will be issued for active, unused, or canceled subscription terms. If you believe a technical duplicate charge has occurred, you must notify support at support@ichingandflyingstars.com within 14 days of the transaction with relevant documentation for investigation.

We reserve the right to immediately suspend platform access for any account associated with an active payment dispute, unauthorized chargeback, or reversed transaction pending formal resolution.

6. Cancellation Policy

Subscribers may contact support to cancel their annual subscription at any time. Cancellation stops the next annual renewal; the current paid subscription period will remain active until its expiration date. No prorated refunds are issued for unused portions of the subscription term. Upon expiration, tiered features will be downgraded to visitor-level access.

7. Referral Program & Promotional Credits

Paid subscribers may receive a personal referral code. A new purchaser using a valid code receives the advertised discount on their plan. During promotional periods announced by us, the code owner may receive a credit to their account balance equal to the advertised percentage of the referred purchase. Credits have no cash value, cannot be withdrawn, transferred or refunded, and may only be applied toward upgrades or renewals on this platform. Self-referral, duplicate or fake accounts, and paid advertising on our brand terms are prohibited. We may change or end the promotion, adjust rebate rates, and reverse or void credits obtained through abuse or from disputed payments, at our sole discretion.

We reserve the sole and absolute discretion, on an individual case-by-case basis and without creating any precedent or obligation toward any other user, to offer private affiliate commission settlements, ex-gratia disbursements, or buyouts of accrued promotional credits for selected commercial partners. Any such arrangement may be limited to credits held for a minimum seasoning period and is reviewed periodically.

8. Intellectual Property & Copyrights

All software, algorithms, visual compass overlays, chart layouts, brand marks, logos, ribbons, documentation, and generated output designs are the exclusive property of I Ching & Flying Stars and are protected by international copyright, trademark, and trade-secret laws. Subscribers receive a limited license to use the platform for personal or professional client work; they do not acquire any ownership, reproduction, or distribution rights in the underlying intellectual property. Reverse engineering, scraping, copying, or creating derivative works from our code or visual assets is strictly prohibited. The Platform reserves the right to immediately suspend or permanently terminate access without prior notice, cure period, or refund upon detection of automated extraction, abnormal query velocity, or intellectual property misuse.

While classical feng shui formulas and concepts belong to the public domain, the original expression of those concepts on this platform does not. All authored bilingual explanatory texts, article syntheses, diagnostic frameworks, interface copy, the Master Compass multi-ring graphical design, chart and canvas visual arrangements, and the selection, coordination, and arrangement of the platform's tools as a composite work are original works of authorship owned exclusively by I Ching & Flying Stars. The 'I CHING & FLYING STARS' name, octagon-and-star brand mark, and associated branding are claimed as trademarks (™). You may not reproduce, republish, translate, adapt, or imitate these original expressions, layouts, or brand assets — in whole or in substantial part — whether or not for commercial purposes, without our prior written consent.

9. Licensed Text Graphic Output Policy

Subscribers are granted a non-exclusive, non-transferable license to capture screenshots, export digital reports, and share calculations generated by the Master Compass Canvas overlay for private client delivery or educational case studies. However, this clearance is strictly contingent upon all corporate logos, brand markers, and the 'I CHING & FLYING STARS' copyright ribbon remaining completely intact, unaltered, and visible within the output. Any attempt to crop, mask, delete, or white-label our visual brand assets to obscure platform ownership constitutes a direct violation of our Intellectual Property rights and will result in immediate permanent account termination without refund.

10. Signature Branding Commercial License

A. Grant of License. Upon confirmed one-time purchase, the Signature Branding Commercial License grants the account holder the right to use their custom logo, emblem, and brand name on high-resolution graphic chart exports, compass alignment diagrams, and floor-plan overlays generated within the platform's tools and workspaces. This license is a one-time purchase with lifetime entitlement attached to the designated account.

B. Licensee Warranties. The account holder warrants that they own, or hold all necessary rights and permissions to, any logo, emblem, or brand name uploaded to the platform, and that such materials do not infringe the intellectual property, trademark, or other rights of any third party. The account holder shall indemnify and hold harmless I Ching & Flying Stars from any claim, dispute, or loss arising from the use of their uploaded brand materials.

C. Scope & Limitations. The license is personal to the designated account, non-transferable, and may not be shared, resold, or sublicensed. It does not grant any ownership or rights in the platform's underlying software, algorithms, visual designs, or brand assets, which remain the exclusive property of I Ching & Flying Stars under Section 8. Accounts without an active Signature Branding Commercial License remain subject to the standard output policy in Section 9. We reserve the right to suspend or revoke the license, without refund, where uploaded materials are found to infringe third-party rights or where the account is terminated under these Terms.

D. Digital Delivery & Final Sale. Upon payment confirmation and automatic activation of the branding controls on the account, the digital commercial license is deemed fully delivered and is strictly non-refundable (consistent with Section 5 of these Terms).

11. Non-Representation & Independent Contractor Status

Use of the platform does not create an employment, agency, partnership, franchise, or joint-venture relationship with I Ching & Flying Stars. Consultants and practitioners who use our tools to serve their own clients remain independent contractors solely responsible for their advice, client relationships, billing, and compliance with local regulations. We do not endorse, supervise, or control any practitioner’s professional services.

12. Disclaimer & Limitation of Liability

The platform provides analytical and educational tools based on classical Feng Shui frameworks. Results are not guaranteed and should not replace independent professional judgment or legal advice. I Ching & Flying Stars disclaims all liability for decisions, investments, renovations, or life choices made in reliance on platform output.

Third-Party Maps & Satellite Imagery

Maps, satellite imagery, address-search results, and related geographic data are supplied by third-party services. Coverage, resolution, positional accuracy, and update frequency vary by location. Satellite imagery is not live and may show historical conditions; recently constructed or altered buildings, roads, and landforms may not appear. We do not guarantee that these materials are current, complete, error-free, continuously available, or suitable for a particular property assessment. Third-party services may change, restrict, or discontinue their data or availability.

Subscribers should independently verify relevant site conditions, boundaries, and measurements using current records and, where appropriate, an on-site inspection. Mapping output is a reference aid, not a certified survey or a substitute for professional surveying, architectural, or engineering advice. I Ching & Flying Stars is not liable for losses arising from errors, omissions, outdated imagery, interruptions, or reliance on third-party mapping materials. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

13. Total Exclusion of Liability for Third-Party Usage & Interpretation

Subscribers who share platform output, screenshots, reports, or interpretations with third parties do so entirely at their own risk. I Ching & Flying Stars accepts no responsibility for how third parties understand, apply, redistribute, or act upon any content derived from the platform. Any claim, dispute, or loss arising from third-party usage must be resolved between the subscriber and the third party; we shall not be joined as a party nor held financially liable.

14. Fraudulent Account Sharing & Eviction Clause

Each subscription is personal to the registered account holder and may not be shared, resold, sublicensed, or pooled across multiple users, agencies, or devices beyond the single active session permitted by our authentication system. We monitor login patterns, device fingerprints, and session anomalies to detect unauthorized sharing. Where we reasonably determine, at our sole discretion, that fraud or account sharing has occurred, we may immediately suspend or permanently evict the account, forfeiture of remaining subscription time, and no refund. Evicted users may be barred from re-registering at our sole discretion.

Fair Use & Automated Request Protection. To protect our proprietary methods and keep the platform responsive for every subscriber, we apply automated usage safeguards. Unusually rapid or high-volume requests, including scripted, automated or bulk extraction, may temporarily pause new calculations. We record these events to assess repeated activity and protect platform integrity. Where we reasonably suspect scraping, automated extraction or misuse, we may restrict or terminate access under this Section. If pauses repeatedly interrupt normal use or you believe a restriction was applied in error, please contact support for an account activity review. Never send your password or sign-in codes.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, government actions, strikes, pandemics, Internet service provider failures, or failures of third-party infrastructure providers.

16. Governing Law & Exclusive Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute, controversy, or claim arising out of or relating to these terms, including their existence, validity, interpretation, performance, breach, or termination, shall be resolved exclusively by the courts of Singapore. Each party hereby submits to the exclusive jurisdiction of the courts of Singapore and waives any objection to venue in those courts. I Ching & Flying Stars (UEN 202635204Z), with its registered office at 21 Bukit Batok Crescent, #09-79 WCEGA Tower, Singapore 658065, is the operator of this platform.

17. Severability & Entire Agreement

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and I Ching & Flying Stars regarding your use of the platform and supersede all prior agreements, understandings, and representations.
